Website Terms of Use

Effective date: July 24, 2026

These Website Terms of Use (“Terms”) govern your access to and use of yachtcharteragents.com and its content, features, enquiry forms, and related online services.

The website is operated by Yacht Charter Agents LLC (“Yacht Charter Agents,” “YCA,” “we,” “us,” or “our”).

By accessing or using this website, you agree to these Terms. If you do not agree, please do not use the website.

1. Purpose of the Website

Yacht Charter Agents provides yacht-charter information, planning resources, destination and experience content, yacht information, and access to professional charter-brokerage services.

The website is intended to:

  • Educate prospective charter clients.
  • Help visitors understand yacht-charter options and variables.
  • Facilitate enquiries.
  • Support the planning and selection of yachts, destinations, crews, and itineraries.

Website content is general information and does not, by itself, create a booking, reservation, agency relationship, fiduciary relationship, or binding charter agreement.

2. Yacht Charter Agents’ Role

Yacht Charter Agents acts as a yacht-charter broker and planning intermediary.

We help clients evaluate options, communicate with relevant industry participants, and arrange charters through yacht owners, central agents, yacht managers, fleet operators, or other providers.

Unless expressly stated in a written agreement:

  • YCA does not own, operate, manage, crew, maintain, or control the yachts displayed or discussed.
  • YCA is not the carrier, vessel operator, hotel, airline, marina, insurer, activity provider, or direct supplier of third-party travel services.
  • The yacht owner, operator, central agent, manager, captain, crew, and other suppliers remain responsible for their respective services, operations, obligations, and legal compliance.

YCA’s role is to apply professional judgement, industry knowledge, relationships, and planning assistance to help clients identify and arrange a suitable charter.

3. Enquiries Are Not Bookings

Submitting an enquiry does not:

  • Reserve a yacht.
  • Guarantee availability.
  • Lock in a price.
  • Create a charter agreement.
  • Require YCA or any yacht provider to accept a booking.

A yacht charter becomes binding only when the applicable written charter agreement has been properly executed, required payments have been received, and any stated conditions have been satisfied.

4. Separate Charter Agreements Control

Every charter is subject to a separate written charter agreement and may also involve addenda, preference forms, payment instructions, insurance documents, waivers, or supplier terms.

Those documents may address matters including:

  • Yacht identity and specifications.
  • Charter dates and cruising area.
  • Charter fee and payment schedule.
  • Advance Provisioning Allowance.
  • Taxes, VAT, permits, fuel, dockage, and operating expenses.
  • Cancellation and default.
  • Force majeure.
  • Guest conduct.
  • Captain’s authority.
  • Safety.
  • Itinerary changes.
  • Insurance.
  • Damage deposits.
  • Dispute resolution.
  • Governing law.

If these Website Terms conflict with a properly executed charter agreement, the charter agreement controls regarding that charter.

Nothing on this website changes or overrides the terms of a signed charter agreement.

5. Availability, Pricing, and Yacht Information

Yacht availability, charter rates, specifications, crew details, locations, itineraries, amenities, equipment, photographs, and operating terms may change without notice.

Information may be supplied by yacht owners, central agents, yacht managers, operators, listing services, or other third parties.

Although YCA seeks to provide accurate and current information:

  • Yacht availability is not guaranteed until confirmed in writing.
  • Rates may exclude APA, fuel, taxes, VAT, gratuities, dockage, permits, repositioning fees, delivery fees, or other expenses.
  • Photographs may show furnishings, equipment, toys, crew, or configurations that later change.
  • Yacht specifications and advertised features may be revised, substituted, temporarily unavailable, or subject to operational restrictions.
  • Sample itineraries are illustrative and not guaranteed.
  • Currency conversions, where shown, are approximate unless expressly confirmed.

Clients should rely on the final proposal, written confirmation, yacht specification, and executed charter agreement applicable to their booking.

6. Itineraries, Weather, Safety, and Captain’s Authority

All itineraries are subject to factors including:

  • Weather.
  • Sea conditions.
  • Port or anchorage availability.
  • Local laws and regulations.
  • Government restrictions.
  • Mechanical or operational considerations.
  • Guest safety.
  • The professional judgement of the captain.

The captain has ultimate authority regarding navigation, vessel safety, operation, and decisions required to protect guests, crew, and the yacht.

Suggested routes, destinations, activities, restaurants, dive sites, fishing locations, and anchorages are not guarantees that a particular place or activity will be available or appropriate during a charter.

7. Travel Requirements and Personal Responsibility

Guests are responsible for confirming and complying with requirements applicable to their travel, including:

  • Passports.
  • Visas.
  • Entry and exit rules.
  • Customs and immigration requirements.
  • Vaccinations or health requirements.
  • Travel insurance.
  • Medical fitness.
  • Diving certifications or activity qualifications.
  • Airline and baggage rules.
  • Local laws.
  • Requirements affecting minors.

YCA may provide general planning information but does not guarantee that such information is complete, current, or applicable to every traveler.

Official government, medical, insurance, and professional sources should be consulted where appropriate.

8. Travel Insurance

Yacht charters may involve substantial non-refundable payments.

YCA strongly encourages clients to consider appropriate travel insurance, trip-cancellation coverage, medical coverage, evacuation coverage, and other protection relevant to their circumstances.

Insurance products contain exclusions, conditions, limitations, and eligibility requirements. Clients are responsible for reviewing policies and determining whether coverage is suitable.

Unless expressly agreed in writing, YCA does not act as an insurer and does not guarantee that any insurer will accept or pay a claim.

9. Website Content Is General Information

Website content is provided for general informational and planning purposes.

It should not be treated as:

  • Legal advice.
  • Tax advice.
  • Financial advice.
  • Medical advice.
  • Insurance advice.
  • Immigration advice.
  • Safety certification.
  • A substitute for a yacht-specific charter agreement.
  • A guarantee of availability, suitability, or outcome.

YCA’s recommendations may depend on information supplied by the client. Incomplete or inaccurate client information may affect the usefulness of any recommendation.

12. Third-Party Links and Services

The website may link to third-party websites or services for convenience or additional information.

This includes, where legally permitted, losses relating to:

  • Lost profits or opportunities.

  • Reliance on general website content.
  • Unauthorized access beyond YCA’s reasonable control.

Any liability relating to an actual yacht charter may be separately governed by the applicable charter agreement and mandatory law.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

By using the website or submitting information, you acknowledge that information may be processed as described in that Policy.

18. Changes to the Website or These Terms

We may update the website, suspend features, correct errors, change content, or revise these Terms.

The effective date will be updated when changes are made.

Continued use of the website after revised Terms are posted constitutes acceptance of those revised Terms to the extent permitted by law.

A separate charter agreement may specify different governing law, jurisdiction, arbitration, or dispute-resolution provisions for the charter itself.

20. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

21. No Waiver

Failure by YCA to enforce any provision of these Terms does not waive that provision or any other right.
